Option Consommateurs has filed a Motion for authorization to institute a class action on behalf of any person who, in Quebec, has purchased polychloroprene (PCP) and has paid an inflated price as a result of an agreement aimed at fixing the price of PCP. The Motion alleges, among other things, that certain manufacturers of this product have conspired in order to unduly restrict competition and to unreasonably increase the price of PCP.
In November 2005, the Honourable Pierre Tessier, j.s.c., approved the partial settlement of this class action against certain Respondents and, in May 2007, the Honourable Jean-Pierre Chrétien, j.s.c., approved the settlement of this class action against the remaining Respondents. These settlement agreements state, among other things, that the class will be able to benefit from a fund established by the Respondents and totaling more than 1.2 million dollars.
Since the period to file claims has expired, this case is now closed.
This class action is lead by Belleau Lapointe, LLP.
